Cyprus Department of Public Works held liable for failure to maintain proper road signs

In an important judgment issued yesterday by the Paphos District Court, prime liability was attributed to the Cyprus Department of Public Works on grounds of failure to maintain proper signs in the course of road works in the Limassol - Paphos main road and damages for personal injuries were awarded.

The action was brought by the driver of a motor vehicle who was injured when his car fell in a one-meter ditch while driving at night on the Paphos – Limassol main road. The central issue was liability and, in particular, whether there were adequate warning signs indicating the ditch and the overall dangers that were present on the road at the time.

After examination of the evidence, the Court held that the Cyprus Department of Public Works had failed to take the necessary precautions for guaranteeing public safety and attributed an 80% liability on the Republic of Cyprus in respect of the claimant’s losses that resulted from the accident. Respective awards for damages, legal fees and interest were ordered.
